Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Eden Earth mobile application, website at edenearthapp.com, and related services (collectively, the "Service") operated by Julian Block ("Eden Earth," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Eden Earth. If you are under the age of majority where you live, you may only use the Service with permission from a parent or legal guardian who agrees to these Terms on your behalf. You represent that the information you provide is accurate and that you will keep your account secure.

3. The Service

Eden Earth lets you log eco actions and cleanups, scan items for classification guidance, track EcoScore and streaks, join circles, RSVP to local events, message within circles, and share impact. Features may change, and we may add, modify, or discontinue parts of the Service with or without notice.

4. Accounts

You are responsible for activity under your account and for safeguarding your credentials. Notify us promptly at support@edenearthapp.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, appear abusive, or create risk for other users or the Service.

5. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes on devices you own or control. You may not copy, modify, distribute, reverse engineer, or create derivative works of the Service except as allowed by law.

6. User content

You retain ownership of content you submit (photos, posts, messages, profile text, event details, and similar) ("User Content"). By submitting User Content, you grant Eden Earth a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content solely to operate and improve the Service (including moderation and backups).

You agree not to post or upload content that:

• Is illegal, harassing, hateful, sexually explicit involving minors, or violent
• Infringes others' privacy, publicity, or intellectual-property rights
• Contains malware, spam, or deceptive impersonation
• Misrepresents cleanup impact or invents harmful false claims about others

We may remove content or restrict features at our discretion, including to comply with law or protect users. We are not obligated to monitor all User Content but may do so.

7. AI and impact estimates

Scan results, plastic estimates, badges, EcoScore, and similar outputs are informational estimates. They may be wrong or incomplete and are not recycling law, medical, scientific, or professional advice. You remain responsible for how you dispose of materials and for complying with local rules.

8. Community and events

Local events and circles may be organized by users. Eden Earth does not guarantee the safety, legality, or quality of any meetup. Attend at your own risk, follow local laws, and use common sense. We are not liable for interactions between users online or offline.

9. Intellectual property

The Eden Earth name, logos, app design, and software (excluding User Content) are owned by us or our licensors and protected by intellectual-property laws. These Terms do not transfer any ownership to you.

10. Third-party services

The Service relies on third parties (for example authentication, hosting, storage, and AI providers). Their availability and terms may affect your experience. App Store distribution is also subject to Apple's terms.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDEN EARTH AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

13. Indemnity

You agree to indemnify and hold harmless Eden Earth and its operator from claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service at any time and may request account deletion as described in the Privacy Policy. We may suspend or end access if you breach these Terms or if we discontinue the Service. Sections that by nature should survive (including licenses you granted, disclaimers, and limitations) will survive termination.

15. Changes to these Terms

We may update these Terms by posting a revised version with a new "Last updated" date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Service and delete your account.

16. Governing law

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules. Courts located in California will have exclusive jurisdiction over disputes, except where prohibited by law or where Apple's terms require otherwise for App Store customers.

17. App Store / Apple notice

If you obtained the iOS app from the Apple App Store, you acknowledge that these Terms are between you and Eden Earth only, not Apple Inc. Apple is not responsible for the app or its content. Apple has no obligation to furnish maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation for the app; any claims related to the app (product liability, legal/regulatory compliance, or consumer-protection claims) are our responsibility, not Apple's. Apple and Apple's subsidiaries are third-party beneficiaries of this section and may enforce it. You represent that you are not in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government prohibited or restricted party list.
